These Terms & Conditions ("Terms") govern your use of the Checkers mobile application and this website (together, "the Service"). The Service is provided by the Checkers developer ("we", "us", "our"). If you do not agree with these Terms, please do not use the Service.
1. Licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices that you own or control, for your own non-commercial entertainment. You may not copy, redistribute, sell, sublicense, reverse engineer or otherwise attempt to extract the source code of the app except to the extent permitted by applicable law.
2. Acceptable use
You agree not to:
- use the Service for any unlawful purpose;
- interfere with, disrupt or attempt to gain unauthorised access to the Service or the systems that support it;
- modify, translate, adapt or create derivative works from the app without our permission; or
- remove, obscure or alter any copyright, trademark or other proprietary notices.
3. Advertising
The app is free to download and is supported by advertising supplied by third parties such as Google AdMob. By using the app you acknowledge that ads may be displayed and that the collection and use of data for advertising is described in our Privacy Policy. We are not responsible for the content of third-party advertisements or the products and services they promote.
4. Intellectual property
The app, including its design, graphics, logo, text and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws. These Terms do not transfer any ownership rights to you.
5. App stores
You may have downloaded the app from a third-party store such as the Google Play Store or the Apple App Store. Your use of the app is also subject to that store's terms of service. In the event of a conflict between these Terms and the store's terms, the store's terms prevail to the extent required.
6. Availability and changes
We may add, change or remove features, and may release updates from time to time. We do not guarantee that the Service will always be available, uninterrupted or error-free. We may suspend or discontinue the Service, in whole or in part, at any time.
7. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose and non-infringement. You use the app at your own discretion and risk.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or related to your use of the Service. Where liability cannot be excluded, our total liability is limited to the amount you paid for the app, which for a free app is zero.
9. Termination
These Terms remain in effect while you use the Service. You may end them at any time by uninstalling the app. We may suspend or terminate your access if you breach these Terms. Sections that by their nature should survive termination, including intellectual property, disclaimers and limitation of liability, will continue to apply.
10. Governing law
These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to conflict of law rules. Nothing in these Terms limits any rights you may have as a consumer under the mandatory laws of your country of residence.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after a change means you accept the updated Terms.
